The Declarant desires to establish a Shared Driveway or other shared driveway between the Severance Building and Severance Way and is requesting to negotiate with (name omitted) for the cost and for the sharing of the costs of constructing the Shared Driveway to create a Shared Driveway, including, without limitation, the installation of the shared driveway between the Severance Building and Severance Way and the costs of installing, extending and maintaining the shared driveway, including tolls, all of which shall be shared equally between the parties; 2. The Severance Building contains parking facilities of a single use, and the Easement Area does not accommodate more than a single type of shared use of parking facilities; 3. The Severance Building is designed to support one general use, such as residential, office, retail, or community commercial and the Severance Building is not designed to accommodate a mixed use of residential, office, retail, or community commercial which would generate less general public use than that which would be generated by the Severance Building; 4. The Severance Building is designed for such buildings or facilities of one to three (3) stories and the Easement Area is designed for multiple-floor buildings; and 5. The Easement Area is designed for a maximum number of tenants. (As amended by Ordinance No. 1879, effective July 1, 1979.)
